These Terms of Service ("Terms") govern your use of skarnyx.io (the "Site"), operated by Skarnyx, the brand of Skarnyx Solutions LLC, a Wyoming limited liability company run by Kevin Goeke from Nashville, Tennessee ("Skarnyx," "we," "us," or "our"). Our registered address is 5830 E 2nd St, Ste 7000 #31970, Casper, WY 82609, USA. By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
1. About the Site
The Site provides general information about Skarnyx and the services we offer. Its content is informational, may change without notice, and is not a binding offer, quote, or guarantee. Submitting the contact form or otherwise contacting us does not create a client relationship or any obligation on our part to provide services.
2. Paid engagements are governed separately
Any paid work we perform for you is governed by a separate written agreement, such as a proposal or statement of work, that covers scope, fees, schedule, intellectual property, warranties, and confidentiality. These Terms do not by themselves entitle you to any services. If a signed agreement conflicts with these Terms for a given project, the signed agreement controls for that project. 3. No guaranteed results
Information on the Site, including any references to search visibility, performance, or business outcomes, is general and does not guarantee specific results such as rankings, traffic, leads, or revenue. Examples of past work are illustrative and do not promise comparable outcomes for any other project.
4. Intellectual property
The Site and its design, code, text, graphics, logos, and the Skarnyx name are owned by Skarnyx or its licensors and are protected by intellectual property laws. You may not copy, scrape, republish, or reuse Site content without our prior written permission. Ownership of work we create for a client is addressed in that client's separate agreement, not here.
5. Acceptable use
You agree not to misuse the Site. You will not use it for any unlawful purpose, attempt to gain unauthorized access to it, interfere with its operation or security, scrape or harvest it through automated means, or submit false, misleading, or malicious content through the contact form.
6. Third-party links and services
The Site links to third-party websites and services, such as Calendly, LinkedIn, and the live sites of past clients. We do not control and are not responsible for their content, practices, or availability. Visiting them is at your own risk and subject to their terms.
7. Disclaimer of warranties
The Site is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, timely, secure, or error-free.
8. Limitation of liability
To the fullest extent permitted by law, Skarnyx and Kevin Goeke will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits or data, arising out of or relating to your use of the Site. Our total liability for any claim relating to the Site will not exceed one hundred United States dollars (USD 100) or the amount you paid us for access to the Site, whichever is greater. Liability for paid projects is addressed in the applicable signed agreement.
9. Indemnification
You agree to indemnify and hold harmless Skarnyx and Kevin Goeke from any claims, losses, or expenses, including reasonable legal fees, arising out of your misuse of the Site or your violation of these Terms.
10. Changes
We may modify, suspend, or discontinue the Site at any time, and we may update these Terms from time to time. When we update them, we will revise the "last updated" date above. Your continued use of the Site after a change means you accept the updated Terms.
11. Governing law and venue
These Terms are governed by the laws of the State of Tennessee, without regard to its conflict-of-law principles. You agree that any dispute relating to the Site or these Terms will be resolved exclusively in the state or federal courts located in Davidson County, Tennessee, and you consent to the personal jurisdiction of those courts.
12. Severability and entire agreement
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect. These Terms, together with our Privacy Policy, are the entire agreement between you and Skarnyx regarding your use of the Site.
